Well, I was lucky with the first guy I took on; he had a major drug problem,
and while I was trying to figure out how to get rid of him, he quit (and
went back to driving 18 wheelers--but that's another story). But now I'm
planning to cut another fellow loose, and while I have a pretty good idea of
how I'm gonna do it, I'm open to suggestions/advice/experience from y'all on
the topic.
Without going into much detail, he's an independant contractor, I took him
on for 3 months and we're about halfway through. There have been a number
of other problems (attendance and frequently asking for money, pilfering
small stuff), but to keep things simple and easy to deal with in the unlikey
event the termination ends up in the hands of a court or gov't people, I
plan to tell him that since he's never paid his weekly rental fee (a rent
that he pays to use a booth in a barber shop), he is in violation of his
contract and according to the terms of the contract he signed, he's history.
The contract allows for a 5 day grace period to catch up on late payments,
after which I have the right to sue for payment and make him pay for my
legal expenses, and to keep all his stuff in my shop.
Anyway, I plan to write a short note saying that since he's not paid any of
his weekly rent for the past month or so, he's in violation of the rental
contract, and I'm throwing him out. I'll pack up his stuff in a box and
will let him take it with him, and should anyone ever ask what happened to
him, I'll evade the question with a simple, "Well, he's not here anymore,"
and not discuss the specifics with anyone.
Anyway, this is the first time I've had to do anything like this, and I'd
like whatever suggestions y'all could offer on how to handle our upcoming
confrontation and thing to watch out for afterward.
I hope to have the site security guard to stand by to help stave off any
physical remonstrations. I can post a sign for the customers saying that
the shop will open 1 hour late (no reason given), and then give him the
official letter with explaination for my action, give him his stuff, and
then tell him to leave. I expect he'll be angry, might even shout a bit,
but don't think things will get any uglier than that. The whole
confrontation shouldn't last more than a few minutes.

Don't make a bigger deal out of this than it has to be. Giving
up an hour of business for this slacker is silly. I wouldn't even
let him in the front door to give him a chance to mess up the
place. Simply meet him out front before opening up. Then
tell him that you haven't been happy with the way things are
going, so you are taking your option to end the arrangement.
Don't worry about his stuff at that point in time. Let him know
that he can make an appointment to come back later to get his
stuff. That way, you both can be calmed down by that time.
I wouldn't bother with any specifics or get into a discussion
or argument with the guy. Just say you are not happy with
how it is working out. If he takes you to court, then you
can pull out the ammo. As it is, most anything you say in
the heat of battle is going to come out wrong, and it might
end up getting used against you. You can also state the money
issue in a termination letter.
